Customers are choosing to use GigSafe because its products and services are superior than anything offered by its competitors, including Openforce.
Time and time again, Gigsafe has heard complaints from Openforce's customers—e.g., Openforce can't process a high volume of drivers at once, Openforce can't adequately track driver documents and proactively recollect expired documents, and Openforce can barely do what it says it can do, to name a few. GigSafe built its system years ago in response to customer demand to address the weaknesses in the market's offerings. Not surprisingly, GigSafe has been gaining market share and securing new customers because independent contractors and companies have realized the superiority of GigSafe's product compared to Openforce's product.
Rather than make its system better, Openforce filed a lawsuit alleging that GigSafe stole its "secret sauce" to win business.
Nothing could be further from the truth. GigSafe independently developed its system in response to customer concerns in the market, never copied any of Openforce's supposed trade secrets, and wouldn't have any reason to. Why? Because GigSafe's system was designed to actually achieve its customers' goals in an efficient manner, something Openforce's system simply does not do.
Recently, GigSafe filed a Motion to Dismiss all of the allegations in the lawsuit because the suit is procedurally flawed. If the case isn't thrown out on its face, GigSafe will file an answer that responds to Openforce's false allegations and claims.
Before long, the market will see that this lawsuit is nothing more than an attempt by Openforce to suppress competition in hopes customers will slow their moves to GigSafe's platform. The lawsuit will bear this out, and GigSafe looks forward to telling its side of the story at the appropriate time. For now, it is content for the Court to address the issues raised in its Motion to Dismiss.
